A collective duty gap arises when a group has caused harm that requires remedying but no member did harm that can justify the imposition of individual remedial duties. Examples range from airplane crashes to climate change. How might collective duty gaps be filled? This paper starts by examining two promising proposals for filling them. Both proposals are found inadequate. Thus, while gap-filling duties can be defended against objections from unfairness and demandingness, we need a substantive justification for their existence. I (...) argue that substantive justification can be found in the normative force of commitments individuals make to others with regard to ends. Along the way, I argue that gap-filling duties must be conceptualized differently in group agents, as compared to non-agent groups: in the former, gap-filling duties can be understood as duties to “take up the slack”; in the latter, this would be a category error. The theory that structured propositions are complex act-types has been independently articulated by Peter Hanks and Scott Soames. The present paper argues that the role of the act in such theories is supererogatory, for the individuation conditions of the act-based propositions remain wholly at the level of concepts and their formal combination, features which the traditional structured proposition theorist endorses. Thus, it is shown that the traditional problems for structured propositions are only ameliorable on the act conception by appeal to (...) the very resources of the traditional conception. It is also shown that the act theories have no act-based account of quantification and other operator-involving relations. An elementary account of propositions is sketched, after Fodor, which retains the virtues of the traditional structural conception without falling into ’Platonism’. (shrink)

The established view regarding ‘brain death’ in medicine and medical ethics is that patients determined to be dead by neurological criteria are dead in terms of a biological conception of death, not a philosophical conception of personhood, a social construction or a legal fiction. Although such individuals show apparent signs of being alive, in reality they are dead, though this reality is masked by the intervention of medical technology. In this article, we argue that an appeal to the distinction between (...) appearance and reality fails in defending the view that the ‘brain dead’ are dead. Specifically, this view relies on an inaccurate and overly simplistic account of the role of medical technology in the physiology of a ‘brain dead’ patient. We conclude by offering an explanation of why the conventional view on ‘brain death’, though mistaken, continues to be endorsed in light of its connection to organ transplantation and the dead donor rule. The question of whether females tend to act more ethically or risk-averse compared to males is an interesting ethical puzzle. Using a large sample of US firms over the 1992–2014 period, we investigate the effect that the gender of a chief executive officer has on earnings management using classification shifting. We find that the pre-Sarbanes–Oxley Act period was characterized by high levels of classification shifting by both female and male CEOs, but the magnitude of such practices is, surprisingly, significantly higher (...) in firms with female CEOs than in those with male CEOs. By contrast, our results suggest that following the passage of the punitive SOX Act, classification shifting by female CEOs declined significantly, whilst it remained pervasive in firms with male CEOs. This suggests that the observable differences in financial reporting behavior between male and female CEOs seem to be because female CEOs are more risk-averse, but not necessarily more ethically sensitive than their male counterparts are. The central tenets of our findings remain unchanged after several additional checks, including controlling for alternative earnings management techniques, corporate governance mechanisms, CEO and chief financial officer characteristics and propensity score-matching. Chomsky's competence/performance distinction has been traditionally understood as a distinction between our knowledge of language and how we put that knowledge to use. While this construal has its purposes, this article argues that the distinction as Chomsky proposes it depends upon no substantiation of the knowledge locution; rather, the distinction is intended to abstract one system out of an ensemble of systems whose integration underlies performance. The article goes on to assess and reject an argument that the knowledge locution, independent (...) of its traditional construal, is of some substance due to the peculiar evidential base of generative theories. While numerous studies have examined the impact that powerful CEOs have on their compensation and overall firm decisions, relatively little is known about how powerful CFOs influence their compensation and important firm financial reporting and operational outcomes. This is somewhat surprising given the critical role CFOs play in the financial reporting process of a firm. Using managerial power theory and the theory of power and self-focus :635–658, 2013), we predict that powerful CFOs employ a two-part strategy to camouflage excessive incentive (...) compensation above what efficient contracting would dictate. First, powerful CFOs use their power and influence to negotiate shorter incentive pay duration to maximize the present value of their performance—based compensation. Second, when their incentive equity compensation vests, we suggest that CFOs manage earnings to further enhance their personal income. Consistent with our theoretical expectations, we find higher levels of income-increasing accrual-based earnings management and real transactions management, a potentially unethical practice, in firms with powerful CFOs who have short pay durations. We discuss the implications of our analysis in the context of mitigating CFO power and managing the ethical environment “tone at the top.”. (shrink)

I will divide my discussion into two. In the first part I will discuss Godin and Gingras's delicious claim that the experimenter's regress is anticipated by Sextus Empiricus's formulation of scepticism. In the second part, I will try to deal with Godin and Gingras's ‘critical argument’, that the experimenter's regress would be redundant if we were less concerned with ‘frightening philosophers’.

The most common objection to fine tuning arguments for theism is that there are, or might be, multiple universes among which the fundamental physicalconstants and parameters vary. This essays describes the two main variants of this objection and argues that they both fail.

Here I try to improve on the available answers to certain long-debated questions and set out some consequences for the answers. Are there limits to the extent to which we can understand the conceptual worlds of other human communities and of non-human creatures? How does this question relate to our ability to engage in other cultures’ practices and languages? What is meant by ‘the body’ and what is meant by ‘the brain’ and how do different meanings bear on the questions? (...) The central answer developed here is that it is possible, given the right circumstances, for a competent human from any human group to understand the culture of any other human group without engaging in their practices though there are barriers when it comes to communication across species. This answer has important social and political consequences and consequences for the debate about artificial intelligence. (shrink)

To develop this question with constant reference to Husserl's teaching rests, however, upon two further reasons connected with our present way of philosophizing. The more general point is that phenomenology continues to make some headway in America, without yet achieving wide support among philosophers. This is due in part to a continued failure to find a common ground of inquiry, despite some similarities that have been pointed out between phenomenology and analytic philosophy. One common theme which is seldom stressed is (...) an interest in the meaning of nature and the validity of philosophical naturalism. At least as far as Husserl is concerned, this is not an easy topic or one that can be handled once for all without finding questions left over to nag the mind. Rather, it is one which he finds it necessary constantly to reopen and rework in the light of new ideas and new emphases in his thought. (shrink)

How can an environmental ethic be developed that encompasses the concerns of both free market proponents and environmentalists? In this article we approach the environment-market debate using Adam Smith’s writings in The Theory of Moral Sentiments, The Wealth of Nations, and Lectures on Jurisprudence. Smith’s guiding principle for solving prominent conflicts of self-interest is that government intervention is required when the economic activities of some cause harm to others. The solution that follows from Smith’s analysis is a governmentfunded, independent, democratically (...) controlled, and democratically accountable mediating structure that derives impartial decisions and is authorized to impose its just and fair decisions on affected parties. In practical terms, this analysis provides the ethical foundation for the wide-ranging development of stakeholder panels composed of public interest group representatives and business representatives and empowered to develop solutions to public conflicts arising out of environmental problems. Anonymous sperm donation offspring often yearn for information about their biological fathers, and as they come of age that yearning increases in intensity. We first explore will and interest theory regarding this desire to know one’s heritage and argue that both theories lead to a right of the offspring to know. We then turn to the donor contract, look at the inconsistencies between donor ability to eschew parental responsibility compared to other biological fathers, and argue that there should be a (...) procedure similar to adoption procedures, whereby sperm donors take seriously the legal severing of their parental rights and responsibilities. We conclude that the offspring have a right to their genetic heritage and call for caring reproductive technological practices that ensure children of donors this right. (shrink)
